Code of Conduct for the Protection of Children and Adolescents (ESNAT)

Tecsecocha Expeditions fully adheres to the Code of Conduct for the Protection of Children and Adolescents against Sexual Exploitation and other forms of Violence in Tourism (ESNAT), in accordance with the guidelines of the Ministry of Foreign Trade and Tourism (MINCETUR) of Peru. This document formalizes our absolute and unrestricted commitment to the protection of the rights of minors and the active fight against the Commercial Sexual Exploitation of Children and Adolescents (ESCNNA), as well as any form of abuse. This pillar is essential for our responsible and legal operation in the Cusco tourism sector.

1. Legal Compliance and Reference Framework

Our commitment is based on Peruvian legislation and international agreements ratified by the Peruvian State, ensuring maximum protection of the rights of children and adolescents.

  • Regulatory Basis: We apply Law N° 29408 (General Tourism Law), the Code of Children and Adolescents, and the specific Regulations of the ESNAT Code of Conduct, making their observance a mandatory requirement for all our staff and suppliers.
  • Zero Tolerance: We maintain a Zero Tolerance policy regarding any act or suspicion of exploitation, abuse, or mistreatment involving children and adolescents. Any violation will be reported immediately to the competent authorities of Peru (National Police, Prosecutor’s Office, and DEMUNA).
  • Traveler Commitment: By hiring our services, the traveler commits to respecting and abiding by the Code of Conduct, refraining from any illegal practice or behavior that puts the physical, psychological, or sexual integrity of a minor at risk.

2. Internal Action and Reporting Protocol

The entire Tecsecocha Expeditions team, including guides, drivers, and administrative staff, is trained to identify and act in potential risk or exploitation situations.

  • Continuous Training: Our staff receives periodic training on Law N° 29938 (prevention and punishment of ESCNNA) and internal procedures for reporting and denouncing potential cases, ensuring a rapid and effective response.
  • Confidentiality and Reporting: Any suspicion or indication must be reported confidentially and immediately to the Code of Conduct manager within Tecsecocha Expeditions, who will proceed with the formal complaint to the police or prosecutorial authority, without exposing the victim.
  • Provision of Information: Our travelers and staff are informed about emergency numbers and reporting channels in Peru, such as Line 1818 of the Ministry of Women and Vulnerable Populations, available 24 hours a day.

3. Requirements for Travel with Minors

For tours and treks that include the participation of minors, Tecsecocha Expeditions applies strict document verification protocols, aligned with Peruvian migration and notary laws.

  • Mandatory Documentation: If the minor is traveling with only one parent, or with a third party, it is mandatory to present the Notarial Travel Permit authorized by the absent parent or both parents, as the case may be, in addition to the minor’s valid ID or Passport.
  • Custody and Responsibility: During the provision of our services, the responsibility for custody and supervision of the minor falls directly on the accompanying father, mother, or legal guardian, as established by the Peruvian legal framework. Tecsecocha expeditions only provides the contracted tourist service.
  • Prohibition of Unauthorized Contact: Our staff is strictly prohibited from soliciting or establishing personal contact with minors outside of scheduled activities and without the presence and explicit consent of the responsible adult.

4. Measures in Hiring and Promotion

Tecsecocha Expeditions extends compliance with this Code to all our business relationships and marketing strategies.

  • Supplier Selection: We require all our suppliers (hotels, transportation, restaurants) to provide a formal declaration of adherence to the Code of Conduct and the implementation of their own protection protocols for minors.
  • Use of Images: We prohibit the dissemination of any photographic or audiovisual material of minors in the tourism context without the express notarial authorization of their parents or guardians, and we ensure that the images used in our promotion are not sexualized nor do they infringe upon their dignity.
