Terms and Conditions

This document establishes the Terms and Conditions (T&C) governing the contractual relationship between the client (traveler) and Authentic Puriq Tours, a travel agency and tour operator registered and domiciled in Cusco, Peru. Our primary objective is to ensure maximum legal and operational transparency in the provision of all our services, including treks and tours, strictly complying with the current Peruvian legal framework, specifically the General Tourism Law and sectoral regulations applied by MINCETUR and the Regional Government of Cusco. These T&C are fundamental to defining the rights, obligations, and responsibilities of both parties, guaranteeing a safe, reliable, and high-quality travel experience in the Cusco region and nationwide.

Service Commitment and Responsibility

Authentic Puriq Tours acts as an intermediary between the client and the final service providers (ground transportation, air travel, hotels, etc.). Our main responsibility is the organization, management, and execution of tour packages as advertised, with a special emphasis on the safety of participants during treks to Machu Picchu and other adventure routes. The agency commits to providing all necessary information truthfully and in a timely manner. Any non-compliance or deficiency in the service directly attributable to the negligence of Authentic Puriq Tours will result in corrective and/or compensatory actions as stipulated by Peruvian legislation.

Booking, Payment, and Confirmation Process

The booking process begins with the client’s formal request and requires a non-refundable deposit to secure the availability of spots, tickets (such as the Entrance to Machu Picchu or the Inca Trail), and accommodations.

  • Booking Confirmation: Once the deposit is received, Authentic Puriq Tours will send a payment receipt and a formal confirmation of the detailed itinerary.
  • Final Payment: The remaining balance must be covered by the deadline established on the invoice, usually 30 days before the start of the trip, unless otherwise indicated for special programs such as the Classic Inca Trail.
  • Non-Payment: Failure to meet the final payment deadline will be considered a cancellation by the client, subject to the penalties described in the Cancellation Policy.
  • Personal Data: The client is responsible for providing accurate personal information (full names, passport number, nationality) that matches the official travel documents required by Peruvian authorities for ticket issuance.

Cancellation and Modification Policy

This section is governed by the mandatory requirement to purchase non-refundable services in advance, particularly in Cusco (trains, entrances to archaeological sites).

Cancellation by the Client:

  • 60 days or more before the trip: Loss of the initial non-refundable deposit.
  • 30 to 59 days before the trip: 50% penalty on the total tour cost.
  • Less than 30 days before the trip: 100% penalty on the total cost, with no right to a refund.

Modifications: Any request for modification of dates or itinerary by the client will be subject to provider availability and may incur additional administrative charges, plus the cost of any new tickets that must be issued.

Cancellation by Authentic Puriq Tours: In the unlikely event that the agency must cancel a tour due to causes other than force majeure, an alternative tour of equivalent value or a full refund of the amounts paid will be offered.

Responsibility, Force Majeure, and Trekking Safety

Safety and experience are the pillars of our service, especially on routes requiring high physical performance.

  • Force Majeure: Authentic Puriq Tours is not responsible for delays, cancellations, or itinerary changes caused by natural phenomena, disasters, social unrest, strikes, or Peruvian government decisions (cases of force majeure). In these situations, the agency will act as a facilitator to reschedule or minimize losses, but additional costs will be assumed by the client.
  • Health and Safety (Cusco Emphasis): The client declares to be in optimal health conditions for carrying out treks at altitude (above 3,000 meters above sea level) and accepts the risks inherent to adventure travel. It is mandatory to have travel insurance that covers medical expenses, accidents, and, preferably, evacuation. The agency reserves the right to exclude a client from a tour if their health status puts their own safety or that of the group at risk, without the right to a refund.
  • Travel Documentation: It is the absolute responsibility of the traveler to carry their original passport or valid ID and other immigration documents necessary to enter Peru and access tourist sites. The agency is not responsible for denial of access due to insufficient or expired documents.
